Use SolarLead to do business with solar homeowners — legally. Don't robocall or mass-text people. Don't contact numbers on the Do-Not-Call list. Don't resell our data. Don't share your login. If you break the rules, we suspend your account, and under our Terms you indemnify us for any legal damage your misuse causes.
1. Scope and incorporation
This Acceptable Use Policy (the “AUP”) governs your use of SolarLead (the “Service”), operated by Rest Mama Inc. This AUP is incorporated by reference into our Terms of Service. By using the Service, you agree to this AUP. Capitalized terms used but not defined here have the meanings given in the Terms of Service.
2. Compliance with telemarketing and anti-spam laws
You are solely responsible for ensuring that any communication you initiate with a person whose information you obtain through the Service complies with all applicable laws. This includes, without limitation, the laws listed below.
2.1 United States — Telephone Consumer Protection Act (TCPA)
You will not, and will not permit any person acting on your behalf to:
- use an automatic telephone dialing system (autodialer) or any artificial or pre-recorded voice message to contact any cellular telephone number obtained through the Service without prior express written consent that satisfies the TCPA's requirements;
- send a text message using an autodialer to any cellular telephone number obtained through the Service without TCPA-compliant prior express written consent;
- place more than one commercial telemarketing call within any twelve (12) month period to a residential telephone number listed on the U.S. National Do Not Call Registry, absent a legally recognized established business relationship or an express written exemption;
- initiate any telemarketing call before 8:00 a.m. or after 9:00 p.m. in the local time zone of the called party.
You will maintain an internal do-not-call list and honor any individual's request to be placed on that list as required by the TCPA. You will regularly scrub your outbound call list against the U.S. National Do Not Call Registry and any applicable state DNC lists.
2.2 Canada — Canadian Anti-Spam Legislation (CASL)
You will not, and will not permit any person acting on your behalf to:
- send a commercial electronic message (CEM) to any electronic address obtained through the Service without express or implied consent as defined by CASL;
- send a CEM that fails to include the sender's identification information or an unsubscribe mechanism that complies with section 6 of CASL;
- place a telemarketing call to any Canadian telephone number listed on the National Do Not Call List (DNCL) maintained by the CRTC, absent a legally recognized exemption;
- place a telemarketing call outside the hours permitted by the CRTC's Unsolicited Telecommunications Rules (generally 9:00 a.m. to 9:30 p.m. on weekdays and 10:00 a.m. to 6:00 p.m. on weekends, subject to provincial variation).
2.3 United States — CAN-SPAM Act
Any commercial email you send to an address obtained through the Service must: (a) accurately identify the sender; (b) include a functioning, prominent unsubscribe link that remains operational for at least thirty (30) days after the message is sent; (c) honor opt-out requests within ten (10) business days; (d) include a valid physical postal address; and (e) use subject lines that are not misleading.
2.4 State, provincial, and local laws
You will comply with all state, provincial, and municipal telemarketing, anti-spam, and privacy laws applicable to you or to any person you contact, including without limitation Florida's Telephone Solicitation Act (FTSA), California's consumer protection laws, Washington's CEMA, and Quebec's consumer protection laws.
3. Prohibited uses of the Service and its data
You will not, and will not attempt to, do any of the following:
- Resell or redistribute the data. Sell, license, transfer, or otherwise make available to any third party the data obtained through the Service, in whole or in part, whether for compensation or free of charge.
- Build a competing product. Use the data, methodology, or outputs of the Service to build, train, or enhance any product or service that competes with SolarLead.
- Operate as a consumer reporting agency. Use the Service or its data for any purpose that would classify SolarLead as a consumer reporting agency under the U.S. Fair Credit Reporting Act, or for any prohibited FCRA purpose (credit, employment, insurance, housing, government benefit determinations).
- Scrape, mirror, or reverse-engineer the Service. Use any automated means (crawlers, bots, scrapers, headless browsers) to extract data from the Service outside the export and API features we expressly provide, or attempt to reverse engineer, decompile, or disassemble any part of the Service.
- Share or resell access credentials. Permit any person other than the single named account holder to access the Service using your credentials.
- Interfere with the Service. Attempt to probe, scan, or test the vulnerability of any Service system, breach security or authentication measures, or otherwise disrupt the operation of the Service.
- Use the data for unlawful purposes. Use personal information obtained through the Service for stalking, harassment, identity theft, discrimination, or any purpose that violates any applicable law.
- Misrepresent your identity. Impersonate any person or entity, or misrepresent your affiliation with any person or entity, in connection with your use of the Service.
- Violate intellectual property rights. Infringe the intellectual property rights of SolarLead or any third party.
- Transmit malicious code. Upload, transmit, or otherwise introduce any viruses, worms, trojan horses, or other malicious code.
4. Appropriate use examples
To clarify what is allowed: you may use the Service to:
- View permit records within your territory, segment them by recency, contractor, system size, or other criteria available in the Service;
- Initiate manual outbound phone calls to numbers obtained through the Service, provided the call complies with Section 2;
- Send a single compliant introductory email to an address obtained through the Service, provided the email complies with Section 2.3 and CASL or other applicable law;
- Mail a physical letter or postcard to a property address shown in the Service;
- Visit a property address for door-to-door outreach, subject to local solicitation permitting and no-knock registries;
- Export limited data sets for internal use within your business, including loading records into your own internal CRM, provided the CRM access is limited to your authorized employees and you do not redistribute the data externally.
5. Responsibility for your users and representatives
If any employee, contractor, agent, or other person acts on your behalf or uses your account, you are fully responsible for their compliance with this AUP. A violation by any such person will be treated as a violation by you.
6. Violation — monitoring, suspension, and termination
6.1 Our right to investigate
We reserve the right, but are not obligated, to investigate suspected violations of this AUP. We may cooperate with law enforcement and regulators in any investigation relating to alleged unlawful conduct.
6.2 Suspension
If we reasonably believe you have violated this AUP, we may suspend your access to the Service immediately and without prior notice. We will attempt to notify you of the suspension and the reason for it as soon as practicable.
6.3 Termination and forfeiture
Material or repeated violation of this AUP is grounds for immediate termination of your account. Upon termination for cause, any fees already paid are forfeited and will not be refunded. Our right to pursue damages or other legal remedies for your violation is not limited by termination.
6.4 Indemnification
You are reminded that, under Section 8 of the Terms of Service, you indemnify Rest Mama Inc. against any damages, penalties, judgments, settlements, or legal fees arising from your violation of this AUP or any applicable law, including without limitation any claim arising from your failure to comply with the TCPA, CASL, CAN-SPAM, or any federal, state, provincial, or municipal privacy or telemarketing law.
7. Reporting abuse
If you believe another Customer is violating this AUP, or if you received an unlawful communication that originated from a party using the Service, please report it to privacy@solarlead.io with as much detail as you can provide (date, time, phone number or email involved, message content). We will investigate all credible reports.
8. Updates to this AUP
We may update this AUP from time to time. Material changes will be announced by email to account holders and posted here at least thirty (30) days before taking effect, except for changes required by law or necessary to address immediate security or legal risks, which may take effect sooner.
